CONTEST RULES AND REGULATIONS

These are the Official Rules ("Rules") for the TVG Online Challenge - Nov. 14, 2009 ("Contest").  The following information is important and all players are responsible for knowledge of the content and complete compliance with the Official Rules.  Failure to comply with any of the rules may result in disqualification at the sole discretion of the National Thoroughbred Racing Association ("NTRA") or its designee.

  • The Contest:  Place one (1) hypothetical $2 win and place wager on each of ten (10) contest races on November 14, 2009.  The top two Players amassing the highest number of points based on the Player's earnings (i.e. the highest final bankroll) from all $2 Win and Place wagers at the end of the day of the Contest will be declared the "Grand Prize Winner." 

GRAND PRIZE: 

The top three finishers earn an automatic berth to the Daily Racing Form/NTRA National Handicapping Championship in Las Vegas, Nevada, to be held January 29-30, 2010, at Red Rock Casino, Resort & Spa in Las Vegas, Nevada. Tour members finishing in the top 30 will earn Tour points.

Must be 21 years of age or older to win Grand Prize.

ELIGIBILITY:
Handicapping Contest is open to legal residents of the United States, aged 21 or older at the time of entry, and residents of Canada (except Quebec) who have reached the age of majority in their province of residence at the time of entry. Employees of the National Thoroughbred Racing Association ("Sponsor"), TVG, NTRA Productions and/or their respective affiliates, subsidiaries, dealers, distributors, retailers, advertising, production and promotion agencies, insurance companies, electronic media firms, and members of their immediate families and households are not eligible to participate. As used in these Rules, "immediate family" means parents, stepparents, children, stepchildren, full and half-siblings and current spouse, regardless of residence. All federal, state, provincial and local laws and regulations apply. Void where prohibited by law.  The handicapping contest  is not open to residents of Quebec. Anyone who is not eligible to gamble due to any court order or other restriction, in any jurisdiction, is not eligible to compete in this Contest.  NTRA reserves the right to deny any person entry into the Contest, for any reason whatsoever. This is a game of skill.  

How To Register:
Registration opens on the TVG Online Challenge - Nov. 14, 2009 on Wednesday, November 11, 2009 at 1:00 p.m. (ET) and selections must be placed no later than 5 minutes prior to the contest's listed post times for each race on November 14.  To register, you must obtain an NTRA Inside Track ID and password from www.ntra.com. There is no cost associated with obtaining an NTRA Inside Track ID and password. Once your ID and password are established, those may be used to login to the game site on ntra.com and participating member and industry Web sites. There is a limit of one registration/entry per person, per e-mail account, per valid e-mail address. All entries submitted with duplicate e-mail addresses will be voided, as will multiple entries submitted under the same name, but with multiple e-mail addresses.  E-mail address must be valid from time of entry through completion of the contest or the entry will be voided. Online entries will be deemed to have been submitted by the authorized holder of the e-mail account from which the entry is submitted, as of the time of entry, and as determined by the Internet Service Provider or other entity responsible for assigning domain names that maintains that account. Winner will be required to provide legally valid photo identification in order to claim prize, e.g. state driver's license.

CONTEST FORMAT

  • The contest date is November 14, 2009 .
  • The Contest consists of one Win and Place wager on ten (10) races.
  • Each Player must place ten (10) fictional $2 Win wagers and ten (10) fictional $2 Place wagers for a total of twenty (20) wagers over the contest.  Failure to make any of the twenty (20) wagers will result in forfeiture of the fictional bankroll designated for each wager which is not made (i.e. a score of zero (0)).
  • If a Player fails to wager on a race, the Player will receive zero (0) points.
  • Players place one (1) $2 Win wager and one (1) $2 Place wager on the same horse.  Multiple wagers on different horses in any one race are prohibited.
  • There is a cap placed on all mutuel payoffs.  The Win cap is 20/1 ($42.00).  The Place cap is 10/1 ($22.00).
  • Official track rulings and regulations shall apply to horses wagered in the Contest.
  • Bankrolls are fictional and may not be cashed at the end of the Contest.

PRIZES
All prizes will be distributed pursuant to the Rules:  All dollar amounts expressed in these rules are in United States currency.  Must be 21 years of age or older to win Grand Prize.  Grand Prize:  The top three finishers earn an automatic berth to the Daily Racing Form/NTRA National Handicapping Championship in Las Vegas, Nevada, to be held January 29-30, 2010, at Red Rock Casino, Resort & Spa in Las Vegas, Nevada. Tour members finishing in the top 30 will earn Tour points.

WAGERING PROCEDURES

  • All players are responsible for ensuring that each wager is placed correctly and that their wagers have been accepted by the computer system.
  • Official program numbers shall be used when placing all wagers.

Scratches

  • Should a scratch occur, it is the Player's responsibility to change the selection prior to the start of the race.  If the Player's selection scratches and no replacement wager is placed prior to post-time, the Player shall be assigned the official tote board favorite as determined by the host racetrack.

Point Tabulation

  • Players accrue fictional earnings/points based on $2 Win wagers and $2 Place wagers.  All Contest earnings are fictional and are for scoring purposes only.
  • If a Player does not place a wager, the Player scores zero (0) points for that race. 
  • Earnings/points will be accrued in gross based on official track payouts, subject to the payoff cap.
  • The Player amassing the highest number of points based on the Player's earnings (i.e. the highest final bankroll) from all $2 Win and/or $2 Place wagers at the end of the day of the Contest will be declared the "Grand Prize Winner." 

TIEBREAKERS

  • In the event of a tie involving prize money, the tie will be broken on the following basis: (1) The higher placing will be awarded to the Player with the greater number of winners over the two (2) days of the Contest; (2) In the further event of a tie, the Player with the highest single mutuel payout (uncapped) will be awarded the placing; and (3) In the further event of a tie, the Player with the next highest single place mutuel payout (uncapped) will be awarded the placing.

Results

  • The individual standings, including the names of the Players and their total bankroll, may be posted periodically during each day of the Contest and at the end of each day of the Contest.
  • All results are unofficial, pending verification that all wagers were made in accordance with Official Rules.  Upon such verification, the winners will be notified on November 20, 2009 or as soon thereafter as possible.  It is anticipated that the winning prizes will be awarded within thirty (30) days in the sole discretion of the NTRA. 

ODDS OF WINNING

  • This is a game of skill, and the odds of winning any prize are dependent upon the number of Players and the skill of the Players.

DISQUALIFICATION FOR UNSPORTSMANLIKE BEHAVIOR and/or VIOLATION OF RULES
The NTRA, in its sole discretion, reserves the right to disqualify any Player it believes to be tampering with or attempting to tamper with the betting process and or operation of the Contest or any Player it believes to be in violation of the Official Rules or to be acting in an unsportsmanlike manner or with the intent to annoy, abuse, threaten, coerce or harass any other person or any person it believes to have influenced or attempted to influence the play of other Players, whether through potential bonuses or other incentives or otherwise. 

GENERAL PROVISIONS
The NTRA is not responsible for lost, interrupted, incomplete, inaccurate or incorrect capture of betting information or for computer, telephone, cable, network, electronic or Internet hardware of software malfunctions, failures, connections, availability or jumbled transmissions, service provider accessibility or availability, or unauthorized human intervention.

  • Players are responsible for the payment of all local, state and/or federal taxes on prizes won in the Contest.  Players who are not United States citizens or Permanent Resident Aliens may be subject to federal tax withholding by the casino. 
  • All trademarks used in connection with this Contest and the promotion thereof are the property or their respective trademark owners and are used for identification purposes only.
  • By participating, Player agrees to be bound by the terms of these Official Rules. 
  • By participating, Player agrees to the use of Player's name, photograph, voice and likeness for the purpose of advertising and promotion in connection with the NTRA and their partners and affiliates without further compensation, except where prohibited. 
  • By participating, Player agrees to release the NTRA and its partners and affiliates, and the directors, employees and agents of each, from any liability, loss or damage incurred by the use, misuse or acceptance of the prize.
  • The validity, interpretation and performance of this Agreement shall be controlled and construed under the internal laws of the state of Kentucky.  No provision of this Agreement shall be construed against or interpreted to the disadvantage of any party by any court or other governmental or judicial authority or mediator or arbitrator by reason of any party having or being deemed to have structured or dictated such provision.  Venue shall be a court of competent jurisdiction in Kentucky.
  • All decisions as to the Official Rules and interpretations thereof are exclusively within the sole discretion of the NTRA and may be changed from time-to-time without notice.  
  • The NTRA reserves the right to cancel or modify the Contest and/or the Official Rules without notice.
  • In the event of inconsistency between these Official Rules and any other document provided in connection with the Contest, the terms of these Official Rules shall be controlling.
  • The NTRA is the sponsor of this Contest.

PRIVACY POLICY
Information submitted on the Registration Form and any information provided in connection with the Contest will be retained by the NTRA and may be used for marketing, research or other commercial and noncommercial purposes.  In addition, the NTRA and its partners and affiliates may send the Players promotions or announcements unless the Player specifically requests that the NTRA not do so in the manner provided in the Registration Form.  Information regarding the Players may be provided to the entity organizing the Contest and their partners and affiliates.

Consent
By registering for this Contest and having read the Official Rules, agree to abide by said Rules and participate in the TVG Online Challenge - Nov. 14, 2009.

In consideration of my participation in this Contest, I do hereby irrevocably authorize the NTRA or its licensees to print, publish, televise or otherwise distribute and use photographs, name or likeness of me. 

Winners will be selected and announced on or about 11/16/2009.  The game will be conducted under the supervision of NTRA Productions, an independent judging agency whose decisions are final in all matters relating to this contest.

There is a limit of one winner per household. All winners will be notified by e-mail or mail and will be required to complete an Affidavit of Eligibility and Liability/Publicity Release which must be returned within 21 days of the date on the notification letter or an alternate winner for that prize will be selected. To be declared a winner, potential winning Canadian entrants also will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question to be administered by mail. In the event any prize notification letter or prize is returned as undeliverable, the prize will be awarded to an alternate winner chosen according to the same method used to select the original winner. There will be NO substitution for prizes except as may be necessary due to unavailability, in which case a prize of equal value will be awarded. Prize is not transferable or redeemable for cash. All prize winners are solely responsible for all taxes and fees, including but not limited to income, withholding and sales taxes, Customs duties and postal fees associated with winner's acceptance and use of the prize. Prize acceptance constitutes permission (except where prohibited) to use winner's name, address (city and state/province) and likeness for information, news, advertising or publicity purposes without additional compensation. Sponsor and its agents are not responsible for any liability associated with the acceptance or use of a prize. Sponsor and its agents will not be responsible for internet technical, hardware, software, telephone or transmission failures of any kind, or congestion on the internet or at any Web site, which may limit a person's ability to enter the contest. Sponsor and its agents are not responsible for any injury or damage to entrant's or any other person's computer related to or resulting from playing or downloading any materials in the contest. Sponsor reserves the right to cancel, in whole or in part, amend or suspend the contest at any time, without prior notice, should any factor interfere with its integrity or proper conduct as contemplated by these Official Rules. Without limiting the generality of the foregoing, Sponsor reserves the right to cancel, in whole or in part, amend or suspend the contest should a computer virus, unauthorized intervention or other cause of any kind whatsoever corrupt the integrity or proper conduct of the contest or to disqualify any entrant found to disrupting the operation of the contest or any Web site WITHOUT ANY LIABILITY TO ANY PERSON. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE CONTEST WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTONERYS' FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Sponsor reserves the right to amend any or all of these rules at any time without notice in order to comply with any federal, state, or local laws or regulations. Contest is void where prohibited.
